Corporate Legal Liability in the Use of AI Systems
The rapid integration of AI systems into corporate processes brings new and largely untested legal risks.
Where Does Liability Originate?
Turkish law does not yet have an independent liability regime specific to artificial intelligence. Where a company AI tool causes harm to a third party through an erroneous decision, liability largely falls on the company itself.
What Should Companies Do?
- Clearly document the role and limits of AI systems in decision-making processes
- Clarify the points at which automated decisions remain subject to human oversight
- Explicitly allocate liability in contracts with AI vendors and suppliers
- Fulfil disclosure obligations under KVKK regarding automated profiling and decision-making
